Terms of Service

Effective date: July 13, 2026

Plain-language note: By downloading or using Top 5 Focus Planner, you agree to these terms. If you do not agree, do not use the app.

1. The service

Top 5 Focus Planner is a personal productivity tool offered by ITER Adventure Co. (“ITER,” “we,” “our,” or “us”). The app helps users select, organize, and review daily priorities.

2. Eligibility and acceptable use

You may use the app only in compliance with applicable law. You may not attempt to interfere with the app, reverse engineer it except where applicable law expressly permits, bypass access controls, or use it to harm others.

3. License

Subject to these Terms and the applicable Apple Media Services Terms and Conditions, ITER grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the app on Apple-branded devices that you own or control.

4. Your content and local storage

You retain ownership of information you enter into the app. Your task content is stored locally on your device and is not hosted by ITER. You are responsible for maintaining access to and security of your device and for any backups you choose to use.

5. Subscriptions and free trials

If paid subscription features are offered, the price, billing period, and any free-trial terms will be displayed before purchase. Purchases are processed through your Apple ID and App Store account.

6. Refunds

Payments and refund requests are handled by Apple under Apple’s policies. ITER cannot directly issue App Store refunds.

7. Availability and changes

We may update, improve, suspend, or discontinue all or part of the app. We do not guarantee that every feature will always be available or that the app will work without interruption or error.

8. No professional advice

The app is provided for general organization and productivity purposes. It does not provide medical, legal, financial, mental-health, or other professional advice.

9. Disclaimer of warranties

To the fullest extent permitted by law, the app is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

10. Limitation of liability

To the fullest extent permitted by law, ITER will not be liable for indirect, incidental, special, consequential, or punitive damages, loss of data, loss of profits, or loss arising from reliance on the app. Some jurisdictions do not allow certain exclusions or limitations, so portions of this section may not apply to you.

11. Indemnity

To the extent permitted by law, you agree to be responsible for claims, losses, or expenses arising from your unlawful misuse of the app or violation of these Terms.

12. Termination

Your right to use the app ends if you materially violate these Terms. Provisions that by their nature should survive termination will remain in effect.

13. Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules, except where the law of your place of residence requires otherwise.

14. Apple-specific terms

Apple is not a party to these Terms and is not responsible for the app or its support. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the license terms against you. Nothing here limits any rights you have under Apple’s applicable terms or consumer-protection law.

15. Changes to these Terms

We may update these Terms when the app, our business, or applicable law changes. The updated version will be posted on this page with a revised effective date.
